HOUSE CONCURRENT RESOLUTION NO. 96
(Delegates Hamilton, Ellem, Schadler, Armstead, Howard, Azinger
and Sobonya)
Requesting the Joint Committee on Government and Finance to study
the disclosure and use of information collected during the
concealed weapons licensing process in West Virginia.
WHEREAS, The State of West Virginia does not have any specific
laws regarding the disclosure or the use of information collected
from applicants or licensees on concealed weapons license
applications;
WHEREAS, The Code of West Virginia does not provide any
provisions regarding who may copy or inspect applications, licenses
and reports regarding any person applying for a permit to carry a
concealed weapon;
WHEREAS, The restriction of public access to concealed weapons
permit records will assist law enforcement agencies during
investigations of criminal cases by restricting access to those
individuals that wish to use the information for illegal or
malicious purposes; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to study the disclosure or use of information collected
on concealed weapons licensing in West Virginia to determine if disclosure of this information is needed; and, be it
Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 2007, on
its findings, conclusions and recommendations, together with the
drafts of any legislation necessary to effectuate its
recommendation; and, be it
Further Resolved, That the expenses necessary to conduct this
study, to prepare a report and to draft necessary legislation be
paid from the legislative appropriations to the Joint Committee on
Government and Finance.
